Dodkos Terms of Service
Company details are being completed.
Policy version: 2026-10-22
Applies to: dodkos.com and every Dodkos workspace, tool and app
Read with: the Dodkos Privacy Policy, which is part of these Terms
1. Who we are and what these Terms are
1.1. "Dodkos", "we" and "us" means the company below, registered in India:
Company details are being completed.
1.2. "You" and "the customer" means the business that asks for a Dodkos workspace. The people the business lets use its workspace ("users") must follow sections 1.5, 5, 6 and 8.1 when they use Dodkos; every other duty in these Terms, including fees (section 7) and covering Dodkos's losses (section 10.5), is the business's alone.
1.3. These Terms are a contract between you and Dodkos. You accept them, in writing, by ticking the box on the signup form (section 3). If you do not accept them, do not use Dodkos.
1.4. If you accept these Terms for a business, you confirm you have the authority to bind that business.
1.5. Every person who uses Dodkos must be 18 or older.
2. The service
2.1. Dodkos provides AI tools for sales teams. Today these are Dodkos CRM, Dodkos Voice (AI calling) and Dodkos WhatsApp. Each customer gets its own workspace: its own container, storage and database.
2.2. Dodkos owns, runs and controls the platform: the software, the AI systems, the servers, the workspaces, the admin console, updates and security. We may add, change or remove features, move a workspace between servers, and update the software at any time. Where a change materially reduces a paid feature, we will tell you in advance (section 13).
2.3. The tools use AI. AI output (call outcomes, lead scores, summaries, replies) can be wrong, and it is not legal, financial or professional advice. You are responsible for decisions you make on it.
2.4. Beta features. A feature marked beta, preview or early access is provided as is. It may change or stop at any time, and comes with no commitment.
3. Signup, subscription and your consent
3.1. Signup is a request. Dodkos reviews each request and may accept or decline it, without giving a reason. You choose a plan and pay the first subscription; only then is your workspace built. Once it is ready, we email the account owner a one-time setup link. There is no account without a subscription.
3.2. How you agree. The signup form has one mandatory checkbox:
☐ I have read and agree to the Terms and the Privacy Policy.
I allow Dodkos to access, monitor and back up my account data, and to use all of it, including call recordings, transcripts, chats and WhatsApp messages, CRM and usage data, to run, secure and support the service and to train, evaluate and improve Dodkos's AI systems, which every customer shares. My data stays on the Dodkos platform and is never sold.
You cannot send the request without ticking it. By ticking it you also confirm that every person who will use the workspace is 18 or older (section 1.5), and you give the assurance about your contacts in section 5.1.
3.3. What we record. With your request we store a consent record: the policy version you accepted, the clauses it covers (section 4.2), the date and time, and the IP address and browser (user agent) it came from. We keep it for as long as your account exists, and for 8 years after it closes as proof of the agreement.
3.4. New versions. When we publish a new version of these Terms or the Privacy Policy, the account owner is asked to accept it on next sign-in. Until it is accepted, the owner's changes in the workspace wait, and the workspace can still be read and exported.
4. Your data and the permission you give Dodkos
4.1. Your data stays yours. Everything you, your users or your leads put into your workspace (leads, notes, call recordings, transcripts, call outcomes, chats and WhatsApp messages, files, CRM records) is "Customer Data" and belongs to you.
4.2. The permission you give us. By accepting these Terms you authorise Dodkos, in writing, to access, monitor, copy, back up, analyse and use all Customer Data, and the usage data of your workspace, for these purposes:
- Run the service — store, process, route, call, message, score and show your data in your workspace;
- Monitoring and safety review — automated monitoring of sign-ins, usage, calls and messages for fraud, spam, attacks and breaches of these Terms; authorised Dodkos staff review data when an automated check flags something, or when a complaint or report comes in;
- Support — when you ask for help, or when we fix a fault that affects your workspace;
- Backups and restore — encrypted daily copies, each kept 30 days; when a workspace is removed, one final copy, kept 30 days; used only to bring back lost or damaged data;
- Legal requests and complaints — answering lawful requests from courts, regulators, telecom authorities and law enforcement, and handling complaints about calls or messages sent from your workspace;
- Training and improving Dodkos's AI — using Customer Data and usage data, including call recordings, transcripts, call outcomes, chats and WhatsApp messages, and CRM activity, to train, test, evaluate and improve Dodkos's AI systems and products. These AI systems, including models Dodkos builds in-house, are shared by every Dodkos customer, so what they learn from your data also improves the service for other customers.
4.3. This permission is a core part of the service and of the price. It lasts while your account is open, and for the retention periods in the Privacy Policy after it closes. From the day your account closes, your data is not used in new training; AI systems trained before that are not retrained to forget it.
4.4. What we promise.
- Your data stays on the platform. We do not sell Customer Data. We do not give it to anyone outside Dodkos except the service providers needed to run the service (Privacy Policy, section 6), under contract, and as the law requires (section 4.2.e). No service provider may train its own models on Customer Data; Dodkos trains its AI systems only on infrastructure under Dodkos's control.
- No customer sees another's data. One customer's business facts, prices, leads and recordings are never surfaced in another customer's calls, chats, prompts, knowledge or playbook. Dodkos tests its AI systems for this before they handle any customer's calls.
- We do not use your leads to contact or sell to anyone on our own account.
4.5. Roles under India's data protection law. For your leads' personal data, you are the Data Fiduciary and Dodkos is your Data Processor, acting on the instructions in these Terms (purposes a–e). For purpose f, Dodkos processes on the authorisation you give here and takes on the duties the Digital Personal Data Protection Act, 2023 places on it for that processing. As Data Fiduciary, you give the people whose data you upload, call or message the notices, and get the consents, that section 5.1 describes, including for purpose f. The Privacy Policy explains this in detail.
5. Your duties: consent, calling rules and no spam
5.1. Consent of your leads. You must have a lawful basis, usually the person's free and informed consent, for every contact you upload, and to call or message them through Dodkos, including by an AI agent. By accepting these Terms you confirm that you have it. Your lead forms and notices must tell people, in plain words, that:
- they may be called, or messaged (including on WhatsApp), by your business, including by an automated or AI assistant;
- calls may be recorded and transcribed;
- their data is processed by service providers, including Dodkos, to run, secure and improve the service, and that Dodkos also uses it to train and improve its AI systems, as described in the Dodkos Privacy Policy. Your notice must name Dodkos and link to dodkos.com/privacy, and the consent you collect must cover this use.
On request you will show us proof of consent for a lead.
5.2. TRAI and telemarketing rules. You are the sender of every call and message made through Dodkos. You bear the consequences the rules set for a sender, including penalties, disconnection of numbers and blacklisting. You must follow the Telecom Regulatory Authority of India's rules on commercial communication (TCCCPR) and any directions under them. This includes:
- not making promotional calls or sending promotional messages to anyone who has not given consent recorded as the rules require, or who has opted out; and not calling or messaging numbers registered on the National Customer Preference Register (DND), unless the person has given you the consent the rules require;
- holding and keeping up your own registration on the telecom operators' commercial-communication platform (DLT), with your own headers, templates and consent records, and using the number series the rules require: the 140 series for promotional calls and the 1600 series (or another series the rules permit) for service and transactional calls, where they apply to you;
- calling only between 09:00 and 21:00 IST, unless the person asked for another time or the law sets a narrower window;
- stopping at once when a person asks you to stop. Dodkos keeps such numbers on a do-not-call list in your workspace;
- not asking a person who opted out for their consent again within 90 days of the opt-out.
Before your first AI calling campaign, the workspace asks you to accept these calling duties once more.
5.3. No spam, no deception, no harm. You must not use Dodkos to send unsolicited bulk messages or calls, to hide who is calling, to pose as someone else, to harass, threaten, pressure or mislead people, for fraud, illegal lending or illegal gambling, or to call emergency numbers. Do not call, message or build a profile of anyone you know or suspect is under 18 without the verifiable parental consent the law requires.
5.4. Lawful content. You must not upload data you have no right to use, illegal content, or malware.
5.5. You are responsible for everything done in your workspace by your users and your connected systems. If a regulator, telecom operator or person makes a claim because you broke this section, you will cover Dodkos's resulting losses and costs (section 10).
5.6. AI disclosure and recording. Calls made or answered through Dodkos may be recorded and transcribed, and may be handled by AI. Dodkos's AI agent always opens by saying it is an AI assistant calling for your business, says it is an AI whenever it is asked, and gives an easy way to stop; this is fixed, the same for every customer. People who call your AI number hear that the call may be recorded; for the calls the AI makes, your lead forms and notices carry the recording notice (section 5.1.b). You must not try to switch off or work around the AI disclosure or a recording notice, or make the agent claim to be a person.
5.7. What Dodkos's AI calling enforces. To help you meet sections 5.1 to 5.3, the AI calling tool:
- calls only between 09:00 and 21:00 IST, and inside any narrower hours you set for a project;
- calls only people with a record of consent (a form or ad submission with its time, source and page, their own call to you, or consent you or your connected systems record), unless you run a campaign on a promotional line and give that line's 140-series number or DLT registration;
- when a person asks not to be called, marks the number do-not-call at once across all your projects and logs when; the AI does not call that number again while it is marked. A person who says they are not interested is not called by the AI for 90 days;
- checks campaign numbers against the National Customer Preference Register when a DND check is set up for your workspace.
These controls help you; they do not move your duties as the sender to Dodkos.
5.8. What your AI caller says. Dodkos sets how the AI caller speaks and the rules it follows, the same for every customer. You supply what it says about your business (its name, your facts, prices, offers and knowledge) and the lists of people it calls. You are responsible for that content being true, lawful and yours to use, and for whom you ask it to call.
5.9. WhatsApp. WhatsApp messages sent through Dodkos are also bound by the messaging channel's own business terms and policies, such as opt-in and approved message templates. If the messaging channel restricts or bans your number or account, that is not a failure of Dodkos, and charges the messaging channel makes for your messages are not refunded.
6. Acceptable use and suspension
6.1. You must not: try to reach another customer's workspace; probe, overload or attack the platform; resell the service without our written agreement; copy, reverse engineer or scrape our software or models; or use Dodkos where the law prohibits it.
6.2. Suspension. We may suspend all or part of a workspace at once, with or without notice, if we reasonably believe there is abuse, spam, a breach of section 5, a security risk, a legal order or legal risk, or unpaid fees. We may also block or pause individual calls, messages or campaigns at once if we believe they may break telecom rules or the terms of a telecom carrier or the messaging channel. We tell you why, unless the law stops us, and restore access once the cause is fixed.
7. Fees and billing
7.1. Prices are shown on dodkos.com/my/products and are charged per workspace per month, plus usage (for example AI calling minutes) where the plan says so; usage is billed as it is used. Prices exclude GST, which is shown on our tax invoices.
7.2. The subscription is paid in advance for each billing period, starting with the first payment before your workspace is built (section 3.1). We do not store card numbers; a payment service provider does.
7.3. We may change prices with at least 30 days' notice. The new price applies from your next billing period.
7.4. Fees are not refundable unless the law or your plan says otherwise. Recurring payments follow the Reserve Bank of India's rules on e-mandates.
8. Accounts and security
8.1. Keep sign-in details private, use 2-step verification where Dodkos offers it, and tell us at once, at the support email in section 1, if you think your account is compromised or misused. Until you tell us, you are responsible for what is done with your account.
8.2. The account owner controls who joins the workspace and what each person can see.
9. Intellectual property
9.1. Dodkos keeps all rights in the platform, the software, the AI systems and models (including those trained or improved under section 4.2.f), the Dodkos name and logos, and in de-identified or aggregated data and insights drawn from use of the platform.
9.2. You keep all rights in Customer Data, including your knowledge base, recordings and the facts you give your AI caller. You give Dodkos a non-exclusive, royalty-free licence to use Customer Data for the purposes in section 4.2, for the periods in section 4.3.
9.3. If you send us feedback or ideas, we may use them freely.
10. Liability
10.1. Dodkos provides the service with reasonable skill and care, but "as is" and as available. We do not promise it will be uninterrupted or error-free, or that AI output will be correct. We do not guarantee that calls connect or that messages are delivered, or any lead, conversion or sale. Uptime figures are targets, not promises, unless a signed order says otherwise.
10.2. Dodkos is not liable for indirect or consequential losses, lost profits, lost leads, lost business, or lost data that a reasonable backup would have saved.
10.3. Dodkos's total liability under these Terms is limited to the fees you paid Dodkos in the 12 months before the event that led to the claim.
10.4. Nothing in these Terms limits liability for fraud, or liability that the law does not allow to be limited.
10.5. You will defend Dodkos against, and compensate it for, any claim, penalty, fine, carrier charge, cost or loss arising from your contacts and Customer Data, your content, the consents you collected, your calls and messages, or your breach of these Terms or the law, except to the extent the claim is caused by Dodkos's breach of these Terms or the law, or by Dodkos's processing for purpose f (section 4.2.f), for which Dodkos is responsible.
10.6. Neither side is liable for a failure caused by events beyond its reasonable control, such as outages of telecom carriers or the messaging channel, orders of a regulator or government, cyber attacks, and natural disasters. This does not excuse fees already due.
11. Closing an account
11.1. You may close your account at any time by writing to the support email in section 1. Paid periods are not refunded, as section 7.4 says.
11.2. We may close an account on 30 days' notice, or at once for a serious or repeated breach of these Terms.
11.3. After closure you have 30 days to export your data. Then the workspace is removed, and its last copies expire as section 9 of the Privacy Policy says.
12. Confidentiality and staff access
Each side keeps the other's non-public information confidential and uses it only for this contract. Dodkos staff who may see Customer Data are bound by confidentiality. Their access is limited to the purposes in section 4.2, and it is logged internally (Privacy Policy, section 7.4). The log is Dodkos's own record and is not shown to customers.
13. Changes to these Terms
We may update these Terms. We will email the account owner at least 15 days before a material change takes effect. When the new version takes effect, the account owner is asked to accept it in the workspace, as in section 3.4; if you do not want to accept it, you may close your account (section 11). If Indian law changes what we must do, for example if Dodkos is notified as a Significant Data Fiduciary, we may change where and how data is stored to comply, and we will tell you. Each version has a date and a changelog entry below.
14. Law, disputes and grievances
14.1. These Terms are governed by the laws of India.
14.2. A dispute the two sides cannot settle between them is decided by a sole arbitrator under the Arbitration and Conciliation Act, 1996, seated in the jurisdiction city named in section 1, in English. The courts of that city have exclusive jurisdiction for interim relief and for anything that cannot go to arbitration.
14.3. Complaints about data or privacy, and complaints about content, calls or messages sent through Dodkos, go to our Grievance Officer, named in section 1. For a complaint about content, calls or messages sent through Dodkos, we acknowledge within 24 hours and resolve within 15 days. For a complaint about data or privacy, we acknowledge within 48 hours and resolve within 30 days.
14.4. Please raise any claim with us in writing promptly. Nothing in these Terms shortens the time the law allows for bringing a claim.
15. General
15.1. If a part of these Terms is invalid, the rest still applies.
15.2. You may not transfer this contract without our written consent. We may transfer it to a successor of our business.
15.3. The English text is the binding version. The Hindi summary is for convenience.
15.4. Contact: the support email in section 1.
15.5. We may name your business as a Dodkos customer and show its logo, for example on our website. Write to us (section 15.4) if you would rather we did not.
